As guided by the Indiana Department of Insurance (IDOI), a licensed producer, agent, or broker may charge a fee on a commercial transaction in which he or she also receives a commission if the provisions of Indiana Code 27-1-15.6-24 are followed.
The fee must be reasonable and reimburse the producer for expenses incurred at the “specific request” of the commercial insured. The insured must be provided written notice before any fee is incurred, and the notice must state the amount of the fee and the basis for calculating the fee.
Also, the amount and basis may not vary among commercial insureds. The fee must be identified separately from premium on any invoice. And the agreement must be pre-approved by the Department.
